Participant agreement

Release of liability, assumption of risk, indemnification & arbitration agreement. Please read this in full before agreeing to it during booking.

In consideration of being permitted to enter, observe, or participate in activities at SayNinja (“Company”), I agree as follows:

1. Assumption of risk

I understand that participation in activities at SayNinja, including but not limited to:

  • Ninja Warrior obstacle training
  • Trampoline activities
  • Climbing walls
  • Gymnastics & tumbling
  • Martial arts (including Taekwondo & kickboxing)
  • Camps, birthday parties, open play, and special events

involves inherent and unavoidable risks, including but not limited to:

  • Falls from equipment or elevated surfaces
  • Trampoline rebound and double-bounce injuries
  • Collisions with other participants
  • Improper landings, flips, or aerial maneuvers
  • Sprains, strains, fractures
  • Head, neck, spinal injuries
  • Concussions and traumatic brain injury
  • Equipment malfunction
  • Emotional distress
  • Serious injury, paralysis, or death

I voluntarily assume all risks, known and unknown.

2. Release of liability

To the fullest extent permitted under New York law, I release and hold harmless SayNinja, its owners, officers, directors, employees, instructors, contractors, volunteers, affiliates, and landlords (“Released Parties”) from any and all claims, demands, damages, or causes of action arising from participation or presence at the facility, including claims of ordinary negligence, except where prohibited by law.

I understand that New York law may limit certain waivers, and this agreement shall be enforced to the maximum extent permitted.

3. Indemnification

I agree to indemnify, defend, and hold harmless the Released Parties from any claims, damages, liabilities, or attorney’s fees arising from:

  • My conduct
  • My child’s conduct
  • Violation of SayNinja rules
  • Any claim brought by or on behalf of a minor participant

4. Medical authorization

I certify that I (or my child) am physically able to participate.

In the event of injury or emergency, I authorize SayNinja to obtain emergency medical care, including ambulance transport if necessary.

All medical expenses are my responsibility.

5. Insurance acknowledgment

I understand SayNinja does not provide medical insurance coverage for participants.

6. Concussion & head injury acknowledgment

I understand the risk of concussion in trampoline, ninja, climbing, and martial arts activities.

If symptoms occur, I agree to remove myself or my child immediately and seek medical care.

7. Binding arbitration agreement

Any dispute, claim, or controversy arising out of participation at SayNinja shall be resolved exclusively through binding arbitration in the State of New York.

I waive the right to:

  • File a lawsuit in court
  • Trial by jury
  • Participate in any class action

Arbitration shall be conducted under the rules of the American Arbitration Association.

If any portion of this provision is unenforceable, the remainder shall remain in full force.

8. Governing law

This Agreement shall be governed by the laws of the State of New York.

9. Photo & video consent

I grant SayNinja permission to photograph and/or record video of myself and/or my child during participation.

SayNinja may use such media for lawful promotional purposes including website, social media, advertising, and printed materials.

No compensation will be provided.

Consent may be revoked in writing for future use only.

10. Digital signature agreement

I agree that my electronic signature shall have the same legal effect as a handwritten signature.

This Agreement remains valid for all future visits unless revoked in writing.

Parent / guardian agreement

(Required for participants under 18)

I am the parent or legal guardian of the minor participant.

I consent to the minor’s participation and accept all risks described above.

I agree to indemnify SayNinja to the fullest extent permitted under New York law.

Attachment A — SayNinja safety rules

All participants agree to:

  1. Follow all staff instructions immediately.
  2. One participant per trampoline unless instructed.
  3. No double bouncing.
  4. No flips without instructor approval.
  5. No roughhousing or reckless behavior.
  6. Wear appropriate athletic clothing.
  7. Remove jewelry before activity.
  8. No food or drink in activity areas.
  9. Report unsafe conditions immediately.
  10. Violation may result in removal without refund.

Attachment B — Birthday party / camp / open play addendum

I understand that during birthday parties, camps, open play, and special events:

  • Group participation increases activity levels
  • Free movement between stations may occur
  • Supervision ratios may vary

I assume all risks associated with these group activities.

For drop-off programs, I agree to remain reachable at all times.
